1. Before you file: send a legal notice

A formal legal notice to the seller or service provider is almost always the first step. It states the deficiency in goods or service, references your invoice, and gives the opposite party 15–30 days to remedy the issue (refund, repair, replacement, or compensation). 2. Choose the correct forum

  • District Commission — claims up to ₹50 lakh.
  • State Commission — ₹50 lakh to ₹2 crore.
  • National Commission (NCDRC) — above ₹2 crore.

Territorial jurisdiction is where the opposite party resides or works for gain, where the cause of action arose, or where you (the complainant) reside or personally work for gain.

3. File online through e-Jagriti

The Government of India's official portal for consumer complaints is e-Jagriti (replacing the older edaakhil.nic.in). You register with your mobile and email, fill in complainant and opposite-party details, describe the deficiency, upload documents, and pay the prescribed fee online. A case number is generated and hearings are listed in the portal itself.

The Act mandates disposal within 3 months (5 months where lab testing is needed), though pendency often stretches this in practice. Orders can be executed like a civil court decree.
